In the current legal landscape, the Trans Law has represented a significant advance in the recognition of the rights of the LGTBIQ+ community. However, a recent alert from the State Attorney General’s Office has focused on possible improper uses of this legislation. Concern has been expressed about sex registration changes that, presumably, would seek to evade responsibilities in cases of gender violence.

The alert from the Prosecutor’s Office: an eye on good faith

The 2024 Report of the State Attorney General’s Office, presented this Friday during the opening of the Judicial Year, has set off alarms. The document indicates that some sex registry changes were being made with the “clear intention of circumventing the Law and harming female victims.” What does this tell us about the application of a law designed to protect and expand rights?

Cases in Ceuta: when suspicion becomes investigation

One of the key points of this concern has been expressed in Ceuta. The city’s Area Prosecutor’s Office has reported two situations where men, involved in criminal proceedings for gender violence, requested the change of registered sex from man to woman. A judge, upon detecting signs of possible fraud, referred the cases to the Public Prosecutor’s Office, which led to the opening of “pre-procedural proceedings” to gather more information.

But the Ceuta cases do not stop there. The Prosecutor’s Office has initiated “several” proceedings for possible abuses of the law. Even a complaint from the Platform Federation for Trans Rights, prompted by a journalistic report, warned about 37 men – military, police and civil guards – who had changed their registered sex without changing their appearance or their name.

How to interpret these figures? Are they isolated incidents or do they point to a broader trend that deserves attention?

The spirit of the law versus the need for data

It is interesting how the Prosecutor’s Office addressed the complaint from the Platform Federation for trans rights. It was considered that initiating proceedings without objective identification data “could be contrary to the spirit of the Law which proclaims the principle of free determination of sex without requiring any requirements.” The complaining association could not contribute beyond journalistic information, which led to the archiving of that specific file.

This point invites us to reflect: where does the balance lie between the protection of a fundamental right such as the free determination of sex and the prevention of possible fraud? Is the lack of identifying data an obstacle to research in some cases?

The voice of the Government: Ana Redondo, Minister of Equality

Given these concerns, the Minister of Equality, Ana Redondo, has offered a reassuring perspective. In Congress, Redondo emphasized that there are “sufficient regulatory instruments” to ensure the correct application of the Trans Law. Its message is clear: “even if the aggressor changes the sex in the Civil Registry, he will not be able to avoid being responsible for the crimes of gender violence committed”.

Furthermore, the minister has praised the work of the Civil Registry, ensuring that its professionals “do their job well” and “when they detect irregularities or suspect the existence of fraud or abuse of rights, they deny registration.”. For Redondo, normality and good use of the law are the tone “in 99% of cases.”

Looking to the future: how to guarantee ethical use of the Trans Law?

The Trans Law has been a milestone for the LGTBIQ+ community, recognizing identities and protecting rights that were invisible for a long time. The concern of the Prosecutor’s Office and the Government’s position open up a necessary debate on how to ensure that this very important law is always applied with integrity and respect for its fundamental objectives.
