The Government of Navarre has begun this month the prior public consultation to draft the Foral decree that will regulate the administrative documentation of trans people residing in the community. The process, active on the Open Government portal, allows citizens and entities to contribute proposals to guarantee treatment in accordance with their felt gender identity.
A legal mandate pending since 2017
The future regulations are not an isolated initiative, but rather the development of a debt outstanding for almost a decade. The Foral Law 8/2017 for the social equality of LGTBI+ people already stipulated that administrations must ensure that trans people were named according to their identity.
This legal provision affects both adults and minors who have not yet been able to modify their official data in the Civil Registry. To date, the lack of a specific regulation has caused care in Navarrese institutions to be unequal and fragmented, depending excessively on the sensitivity of each administrative unit.
Legal security and end of discrimination
The initiation report of the procedure highlights that the discrepancy between the stated identity and the registration data generates unwanted public exposure. These situations frequently occur in access to health and educational services, leading to bureaucratic obstacles and possible scenarios of direct discrimination.
With the new regional decree, the Executive seeks to establish a common framework that provides legal certainty. The objective is that both trans people and public employees have a clear roadmap that avoids arbitrariness in the management of cards, files and internal records of the Navarrese Administration.

The development process is in its initial phase, which allows a real impact of social and professional entities in the sector. Any interested party can send their point of view on the articulation of this regulation so that the final text is as robust and representative as possible.
