US President Donald Trump has issued a new notice to California school districts: those who do not follow his administration’s guidance on transgender policies could be left without federal funding.

For now, neither the White House nor the Department of Education have clarified how that threat would be applied. The comment appeared on social networks and has raised doubts about its real scope.

The background: financing and political control

In United States, most of the resources for public education come from local and state governments. However, federal money represents a non-negligible part, especially in support programs for students in vulnerable situations. The possibility of Trump cutting that funding puts schools in a position of uncertainty.

Beyond the economic debate, the warning is part of an open conflict between the Republican administration and the state of California, led by Democratic Governor Gavin Newsom. It is not the first time that both have clashed over LGTBIQ+ rights.

A legal battle for school sports

Just a month ago, the Trump administration sued California for allowing trans students to compete on girls’ high school teams. The Department of Justice alleged that these regulations violate Title IX, the federal law that protects against sex discrimination in the educational field.

In its argument, the administration argued that these policies “degrade” cisgender girls by prioritizing what they define as an “amorphous gender identity.” According to the lawsuit, the young women would be losing podiums, scholarships and recognition due to the presence of trans athletes in competitions.

California, however, has maintained a law for more than a decade that guarantees trans students the right to join sports teams and use facilities in accordance with their gender identity.

The case that ignited the controversy

The most recent spark was the victory of a trans student in a state track championship. Trump openly criticized that victory and used it as an example of what he believes is an injustice towards cisgender female athletes. Deputy Attorney General Harmeet Dhillon went so far as to accuse the sports body of violating the Constitution by allowing their participation.

The federal Department of Education has also opened an investigation into California’s rules. In July, it declared that these violate Title IX and gave the state ten days to rectify. Sacramento refused.

A debate that transcends the legal sphere

What is at stake goes beyond laws and lawsuits. Should gender identity be fully recognized in the sporting field? What about the right of trans people to compete on equal terms? And how does that mesh with the perception of justice for other athletes?
