The office of the UN High Commissioner for Human Rights, led by Volker Türk, has been categorical in describing the regulations as a tool of discrimination. Through an official statement, the organization has applauded that the Court of Justice of the European Union (CJEU) ratifies that the 2021 law violates fundamental human rights.

For the UN, this judicial ruling is a necessary step to protect a community that has been the target of legislative attacks in Budapest. The organization insists that States cannot legislate against the very essence of human dignity under any political justification.

A court ruling that marks a milestone in the European Union

The opinion issued this past Tuesday by the CJEU is not just another resolution. For the first time in a procedure against a Member State, the court has declared a violation of Article 2 of the Union Treaty. This article includes the fundamental values ​​of respect, freedom and non-discrimination based on sexual orientation and gender identity.

European justice has determined that Hungarian regulations marginalize the group by deliberately associating homosexuality and sex change with serious criminal behavior, such as pedophilia. This connection, according to the court, has no legal basis and violates the integrity of LGTBI people.

The origin of the controversial law of 2021

The conflict dates back to June 2021, when the Hungarian Parliament approved a reform promoted by Orbán’s Executive. Under the pretext of toughening penalties against pedophilia, the Government introduced clauses that effectively censor the visibility of the group in the public and educational spheres.

Among the most controversial measures is the prohibition of talks on diversity in schools, prohibiting any content that could “promote” homosexuality among minors. The UN has settled the issue by recalling that freedom of expression and family life are pillars that Hungary must immediately restore by eliminating these legal clauses.
