  • The central case is that of David Osuna: according to the complaint, she was arrested for gender violence when, in her opinion, it should have been classified as domestic violence.
  • TNN, created in 2024, is facing accusations of “fraud of law”; the FELGTBI+ asked the Prosecutor’s Office to take action against its members. The union rejects this and speaks of transphobia.

The trans police in Ceuta affiliated with the TNN union have filed a complaint with the Civil Guard of the autonomous city, claiming that they were arrested and treated under the regime of gender violence despite being legally recognized as women. According to The Objective on October 18, 2026, five agents are affected.

What do the trans police in Ceuta report?

The case of David Osuna, according to the complaint

The main case mentioned in the complaint is that of David Osuna, arrested for gender violence following a complaint from her partner related to their minor child. According to the version of the complaint, Osuna voluntarily went to the police station, handed over the child, and was arrested after consultations with the duty judge and the regional operations chief.

The complaint states that the correct classification should have been domestic violence, since the Organic Law 1/2004 refers to violence perpetrated by men against women. Since Osuna is legally recognized as a woman, TNN argues that this regime should not have been applied to her.

Additionally, the complaint alleges a series of irregularities: movement restrictions, treatment as a male in the reports from the Scientific Police and the UFAM, signing of documentation from the VioGén system, assignment of the case to a Court of Violence against Women, time contradictions in the proceedings, and the absence of a medical report of injuries.

What has happened in the courts?

The duty judge dismissed the habeas corpus that was requested, considering the facts plausible and that the reading of rights did not generate defenselessness. Subsequently, according to published information, the complainant withdrew the complaint in the Court of Instruction No. 4 for Violence against Women, without any precautionary or civil measures being taken regarding the minor.

Osuna later filed a lawsuit for false accusation in the Court of Instruction No. 5 of Ceuta, which was archived. She has appealed to the Provincial Court and demands that the possible criminal or disciplinary responsibilities of the intervening agents be investigated.

What is the TNN union?

The Trans Non-Normative Police Union (TNN) is an organization created in 2024 that groups agents who have modified their registered sex designation. According to The Objective, it is mainly composed of agents with masculine aesthetics and names who changed their registered sex under the trans law, without hormone treatment or surgery.

TNN demands that its members be recognized as women for the purposes of searches, changing rooms, and protocols, and argues that the institution is violating the law. According to the same media, its affiliates claim that a significant percentage were reported for gender violence while still being recognized as males.

The criticisms of “fraud of law” and the union’s response

Since its creation, TNN has been accused of “fraud of law” by various groups. According to The Objective, the FELGTBI+ asked the Prosecutor’s Office to take action against its members for “grotesquely pretending to be trans.” For its part, the Alliance Against the Erasure of Women has pointed out what it considers contradictions and “gaps” in gender self-determination.

The union rejects these accusations. Its spokespeople maintain that “they do not commit any fraud” and label the criticisms as “transphobia” or “trans-excluding hate.” The media adds that TNN has reported LGTBI associations and journalists.
